Small Business Fair Dismissal Code

The Small Business Fair Dismissal Code came into effect from 1 July 2009.

The Fair Dismissal Code applies to small business employers with fewer than 15 full-time equivalent employees.

Small business employees cannot make a claim for unfair dismissal in the first 12 months following their engagement. If an employee is dismissed after this period and the employer has followed the Code then the dismissal will be deemed to be fair.

Employees who have been dismissed because of a business downturn or their position is no longer needed cannot bring a claim for unfair dismissal. However, the redundancy needs to be genuine. Re-filling the position with a new employee is not a genuine redundancy.

Limited access to ATO systems

The ATO has advised that it will begin implementing itsnew income tax processing system from today.

This means that many ATO systems will be unavailable from 12.01am EDT Friday, 22 January to 6.00am EDT Wednesday, 27 January 2010.

As a result there will be no access to information through the ATO's portals during this period. Also, ATO call centre staff will only be able to provide limited assistance as they will not have full access to personal or account information.

Industrial relations update

From 1 January 2010, several changes to Australia's workplace laws come into effect. These changes will affect many Licensees who employ staff in their business. The changes include the introduction of new National Employment Standards and many State employers moving into the national system.

National Employment Standards

The Fair Work Act introduced a set of ten minimum workplace standards known as the National Employment Standards. These standards apply to all employers and employees in the national workplace relations system.

Fair Work Information Statement

Employers must now provide any new employees with a copy of the Fair Work Information Statement as soon as possible after they commence employment. (This is one of the ten National Employment Standards.)

The Fair Work Information Statement summarises the National Employment Standards and contains other information regarding termination of employment, freedom of association, transfer of business and other matters.

The Fair Work Information Statement can be posted, emailed, faxed or given personally to the new employee.

What award should I use to pay my staff?

Many LPOs will now be covered by the federal Postal Services Industry Award. To determine which Award applies to your business, visit Fair Work Online or phone the Fair Work Infoline on 13 13 94.

Wording of the Postal Services Industry Award (AW830245) can be downloaded from the Fair Work Australia website.

Licensees are strongly urged to contact Fair Work Australia to determine which Award applies to their business.

Award Modernisation

In 2008, the Minister for Employment, the Hon Julia Gillard, directed the Australian Industrial Relations Commission (AIRC) to review and rationalise awards. The Postal Services Industry Award was one of the awards to be modernised.

As part of this rationalisation, it was deemed that casual loading for many awards (including the Postal Services Industry Award) be standardised at 25%, an increase from the current 20% under the Award. At the AIRC hearing in March 2009, POAAL argued against an increase in casual loading, noting that small businesses in the postal industry are unable to increase the cost of postage products to compensate for an increase in staffing costs. Licensees sell postal products and services which have fixed prices, controlled by Australia Post.

In order for base domestic postage to increase Australia Post must apply to the ACCC and any such application undergoes a rigorous and public examination in order for the increase to be granted. Australia Post does not take into account the wages of licensed post offices when deciding whether or not to apply for an increase in the base postage rate.

The Award has since been deemed to be an Enterprise Award and has not yet been subject to modernisation. Licensees will be kept informed of any further developments.

The ATO has announced that it is planning to implement a new income tax processing system during January 2010. As a result, e-tax 2009 will not be available from 4 January 2010.

ACCC objects to postage increase

The ACCC has announced that it will object to Australia Post's proposed changes to postage rates.

In July, Australia Post submitted a draft notification to the ACCC proposing an increase of five cents to the BPR.

The proposal also included an increase in other Ordinary Large Letter prices to align to multiples of the BPR, increases to prepaid envelopes and seasonal greeting cards, and an average increase to PreSort prices of 7.2%.

Australia Post has stated that it will further discuss its proposal with the ACCC following the release of the ACCC's objection.

Inquiry into unconscionable conduct

The Federal Government has launched an inquiry into unconscionable conduct.

An expert panel has been appointed by the Minister for Competition, Dr Craig Emerson, to consider issues arising out of the Government response to the Senate Economics Committee inquiry into unconscionable conduct.

ATO launches e-newsletter for SMEs

The ATO has created an online newsletter called SME Communicator for small and medium enterprises (SMEs).

The newsletter will provide information specific to small and medium enterprises on topics such as tax and superannuation.

Union visits to LPOs

Representatives of the CEPU (the union representing employees in the postal industry) have visited a number of LPOs recently.

Licensees should familiarise themselves with some of the key parts of the Fair Work Act that deal with a union's right to hold discussions with employees.

Here are some questions to ask yourself first:

  • Do you have employees?
  • Has the union written to you directly?
  • Have you been given at least 24 hours notice?

Under section 484 of the Act, an authorised union representative may enter a workplace for the purposes of holding discussions with one or more employees who work in the premises and who wish to participate in discussions.

Section 487 of the Act notes that notice must be given. Notice must be given during working hours at least 24 hours but not more than 14 days before the entry.

The Fair Work Act also specifies that any notice given under section 484 must contain a declaration that the union is entitled to represent employees. The entry notice must also specify the provision of the union's rules that entitles the union to represent those employees. (Refer Section 518(3).)

If you receive an entry notice from the CEPU, make sure it meets the requirements as legislated under the Fair Work Act.

UK's Royal Mail will launch a new stamp issue in early 2010 featuring classic album covers.

One of the interesting features of the stamps is that the stamps won't be square or rectangular. The stamps will have one curved side.

Telstra scraps $2.20 fee

Telstra will no longer charge customers $2.20 for paying their Telstra account at a post office. Customers who have paid the $2.20 fee since it was introduced in September will have the fee refunded.

POAAL lobbied hard to have this fee rescinded. Licensees from all over Australia contacted POAAL when the fee was announced, pointing out that this fee would be unfair on customers and could hurt Licensees' businesses.

It is pleasing that Telstra has recognised the deleterious effect the fee had on its customers. POAAL hopes that other telephone companies will follow Telstra's lead and remove their discriminatory over-the-counter bill payment fees.

Canberra meeting - Sunday 1 November

POAAL's Bob Chizzoniti will host a Meet 'n Eat on Sunday 1 November in Canberra at the Mawson Club at Mawson, 12noon - 2pm.

Small business tax break

The federal government is offering an extra tax deduction to small businesses on plant and equipment purchases. The tax break covers new, tangible, depreciating assets as well as improvements or additions made to existing assets.

The asset must be bought and used or installed within certain timeframes in order to be eligible for the tax break.

If your business has a turnover of less than $2m, then to qualify for the 50% tax break you must buy the asset before 31 December 2009 and install it before 31 December 2010.

For businesses with an annual turnover of $2m or more, the tax break is 30% and applies to assets bought before 30 June 2009 and installed before 30 June 2010.

POAAL's submission to ACCC on postage increase

POAAL has made a submission to the ACCC in response to Australia Post's application for an increase in the BPR. POAAL supports Australia Post's application.

The ACCC published an issues paper in August inviting interested parties to comment on Australia Post's application.

2009/2010 LPO Commissions

POAAL recently concluded consultations with Australia Post regarding LPO commissions for banking and billpay for 2009/2010. Australia Post has sent a circular to all Licensees advising of the increases and also noting that the interest-free security loan is still available.

POAAL is pleased with the outcome of the consultations with Australia Post, especially the increases in payments to Licensees.

POAAL meets with Shadow Minister, Senator Minchin

Shadow Minister for Communications Senator Minchin

Senator Nick Minchin, the Shadow Minister for Communications, visited the POAAL National Office in Melbourne earlier this month. He and his adviser showed a keen interest in the business both of the Association and its members.

Senator Minchin served as Minister for Finance in the previous federal government, and as such has some experience dealing with Australia Post.

POAAL briefed Senator Minchin on matters of relevance to Licensees, Franchisees and Mail Contractors. Senator Minchin showed particular interest in product availability and margins for Licensees/Franchisees as well as transfer of business to corporate outlets. He recognises the role played in the wider postal network by Licensees, Agents, Franchisees and Contractors, and requested that he continue to be kept informed of industry matters impacting on POAAL members.

US Postal Services posts US$1.9bn loss

The US Postal Service has announced a net loss of $1.9bn during its fiscal second quarter.

The economic recession and longer-term financial pressures, such as the diversion of letter mail to electronic alternatives, continued to reduce mail volume and revenue.

In the second quarter, total mail volume came to 43.8 billion pieces, down 7.5 billion pieces, or 14.7%, compared to a year ago.

The USPS has taken measures to match work hours to the reduced mail volumes. These measures have resulted in a work-hour decline of 58 million hours - the equivalent of a reduction of 33,000 full-time employees - in the first half of the 2009 financial yar. This is despite the number of delivery points increasing by 1.1 million from the same period last year.

The USPS is also being crippled by massive payments for retiree health benefits.

Small business tax break

The Federal Government has introduced a $2.7 billion Small Business and General Business Tax Break to boost business investment.

Who can claim the tax break?

To benefit from the tax break, a small business must have a turnover of $2 million a year or less.

What does the tax break mean for your small business?

Small businesses will be able to claim a bonus deduction of 30 per cent for eligible assets costing $1000 or more that they:

  • Acquire from 13 December 2008 to 30 June 2009, or start to construct between these times; and
  • Have installed ready for use by 30 June 2010.

Small businesses will be able to claim a bonus deduction of 10 per cent foreligible assets costing $1000 or more that they:

  • Acquire from 1 July 2009 to 31 December 2009, or start to construct between these times; and
  • Have installed ready for use by 31 December 2010.

Which assets are eligible?

Assets eligible for the allowance are new tangible depreciating assets and new expenditure on existing assets used in carrying on a business for which a deduction is available under the core provisions of Division 40 (Capital Allowances) of the Income Tax Assessment Act 1997.

How can I claim the tax break?

The deduction will be available to the taxpayer who is entitled to the capital allowance deduction in respect of the asset. The deduction is on top of the usual capital allowance deduction claimable for the asset as part of your income tax return.

The deduction is claimable in the income year in which the asset is installed and ready for use.

AUSTRAC compliance report

AUSTRAC has written to Licensees regarding Licensees' obligation to submit a Compliance Report to AUSTRAC for the period 1 January 2008 to 31 December 2008.

Reports must be submitted to AUSTRAC by 31 March 2009.

Licensees who have EPOS will be able to access the paperwork electronically through EPOS. Alternatively, the report may be lodged online at the AUSTRAC website www.austrac.gov.au/online.

In discussions with POAAL, AUSTRAC has asked that Licensees complete the report as best they can and make every effort to meet the 31 March deadline.

If Licensees have problems completing the paperwork or have specific questions regarding the Compliance Report, contact AUSTRAC in the first instance on their national number 1300 021 037.

At a POAAL Branch meeting held in June last year, AP's Mark Warren agreed to return to another meeting and update Licensees on progress on a range of matters in the State relating to Licensees.

Christmas, staff leave and locum work has prevented the meeting being held before this, but we are pleased that Mr Warren has accepted our invitation to attend the NSW Branch meeting on 14 April.

Award modernisation

POAAL appeared in the Australian Industrial Relations Commission on behalf of Licensees recently regarding the "modernisation" of the Postal Services Industry Award.

Licensees may have read reports in the press recently regarding the award modernisation process. The Postal Services Industry Award is also undergoing this process.

Licensees will be kept informed of any developments that will impact on staff pay or conditions. A further AIRC hearing will be scheduled to discuss the Award.

Minister to launch POAAL Benevolent Fund

Minister for Communications Senator ConroyPOAAL is pleased to announce that the Minister for Broadband, Communications and the Digital Economy, Senator Stephen Conroy, will officially launch the POAAL Benevolent Fund on Good Friday.

Senator Conroy is the Federal Minister with responsibility for Australia Post.

The Official Launch of the Benevolent Fund will take place at a function at the Marriott Hotel on Friday 10 April. The function commences at 6pm and is open to POAAL members and their guests.

2009 is POAAL's 70th anniversary year and this seems an appropriate way to mark the occasion.

POAAL National Conference - cancelled

POAAL has decided to not to proceed with this year's National Conference scheduled to be held in Melbourne over Easter.

The impact of natural disasters, including the Victorian bushfires and extensive flooding in Queensland and Northern NSW, combined with the current economic uncertainty has led to calls by Licensees, Contractors and the POAAL Board to spend the funds in more practical ways to help those in need.

POAAL has been overwhelmed by the offers of help from Licensees and Mail Contractors who have been distressed at the plight of their colleagues affected by natural disaster. The feeling among members, confirmed by our Board, was that we should be helping our members in distress at this time.

It is with this in mind that POAAL has decided to set up a Benevolent Fund to help Licensees and Contractors in times of severe financial hardship such as these. The Fund will be kick-started by the money which POAAL would have provided for the Conference and the deposit refunded by the Grand Hyatt Melbourne. More details of the Fund will be circulated when fully developed, and Licensees and Contractors will be able to contribute in this way to assist their colleagues in need now and in the future.

For those members who will be in Melbourne at Easter, we will proceed with the Welcome Reception on the night of Friday 10 April, a "meet the Board" session on the Saturday at the Grand Hyatt plus the Anniversary Dinner on the night of Saturday 11 April. A collection will be taken at the Dinner for the Fund.

Victorian bushfires

Many POAAL members, both Licensees and Mail Contractors, have been affected by the bushfires in Victoria. Business premises have been razed, homes have been destroyed, livelihoods put in doubt.

Our thoughts and prayers are with our colleagues who have suffered loss due to the disastrous February fires.

We have been liaising with Australia Post and warmly support the Managing Director's offer of practical immediate help by Australia Post and some form of income maintenance for those of our colleagues most severely hit by this disaster.

Victorian bushfire relief

Australia Post has announced that it will donate $1m to the Victorian Bushfire Relief Fund. Members of the public will be able to make donations at post offices across the country.

Mail deliveries will be affected in many communities across the state with many areas still too dangerous to enter.

Several Licensed Post Offices are believed to have been destroyed by the fires.

Telstra Payment Card

Last year Telstra wrote to all Telstra Payment Card holders advising that the Card will be discontinued. Licensees were concerned that the withdrawal of this service would mean that customers could no longer pay part-payments of their Telstra account, which could put financial stress on some Telstra customers.

POAAL wrote to the Minister for Communications, Senator Stephen Conroy, who has recently responded to POAAL. He advises that he took the matter up with Telstra, and Telstra has now advised him that customers can still make part payments (minimum of $20) at post offices and Telstra shops using the barcode on the bill, instead of the Telstra Payment Card.

Licensees may wish to advise Telstra Payment Card holders of this option, so that customers can continue to pay their Telstra invoices at the LPO.

Christmas period opening hours

The POAAL National Office will be closed only on public holidays and weekends during the Christmas/New Year period. No "authorised holiday" for us! The office will be operating on reduced hours and staffing during this period.

Credit Arrangements with Australia Post

Following continued representations from POAAL, Australia Post has advised POAAL at a recent consultative meeting that it will review the credit terms on AP stock. This is welcome news for Licensees.

POAAL hopes that revised, competitive credit terms from Australia Post will encourage more Licensees to stock a greater range of Australia Post retail products.

POAAL will keep Licensees informed of any developments as they come to hand.

Licensee PO Box payments

Australia Post has advised POAAL that it will pay Licensees their outstanding backpay entitlements for PO Box payments.

When the basic postage rate increased from 50c to 55c, the LPO PO Box payment was increased following consultation between AP and POAAL. The LPO Arrangements Payment Scheme specifies that this is a lump sum in advance payment.

POAAL has been pressuring AP over the last two months to honour its obligations to Licensees, and it is pleasing that AP has now agreed to pay Licensees their full entitlements.

The payment will be made with December 2008 LiPOMS.

New Award rates

The Australian Fair Pay Commission has increased the standard Federal Minimum Wage and all Australian Pay and Classification Scales by $21.66 per week.

This applies to workers in all LPOs respondent to the Postal Services Industry Award. In addition the wage increases apply to all LPOs in Victoria where the predominant business of the LPO is the provision of postal services.

The decision takes effect from the first pay period on or after 1 October 2008.

These increases flow on to junior employees, employees to whom training arrangements apply, employees with a disability, casual employees and employees receiving basic piece rates of pay.

Free employee record keeping templates

Interactive templates are available from the Workplace Ombudsman to help small businesses better manage their time and wages record keeping and payslip obligations under Australia's workplace relations laws.

The free templates can be downloaded from the Workplace Ombudsman website and are recommended best practice models.

"If you employ workers under Commonwealth workplace relations laws you are legally required to keep accurate and complete time and wages records and to issue pay slips to every worker," said Workplace Ombudsman Nicholas Wilson.

"These obligations exist to ensure workers receive their correct wages and entitlements, and also protect both you and your employee if a compaint or dispute arises."

"As the independent watchdog, it's our job to ensure the rights and obligations of both workers and employers are understood and enforced fairly."

    The Workplace Ombudsman website has templates and information for managing the following:

AUSTRAC attends Melbourne meeting

At the Victorian Branch meeting in Melbourne on 14 August 2008 we were pleased to welcome AUSTRAC representative David Mackey.

David's presentation covered the background to the AML/CTF Act and the day-to-day implications for the Act in LPOs.

Licensees took the opportunity to ask many questions of David - his presentation didn't finish until 10pm as a result of extensive questioning from Licensees.

David will be speaking at more POAAL meetings around Australia, including the Adelaide meeting on Sunday 24 August.

ACCC issues final decision on postage rises

The ACCC today issued its final decision not to object to Australia Post's application to increase the basic rate of postage.

Australia Post has proposed to increase the cost of basic domestic postage from 50c to 55c.

The next stage in the process is for Australia Post to apply to the Minister for Broadband, Communications and the Digital Economy for approval. POAAL has today written to the Minister, urging him to approve the increase.

The Chairman of the ACCC, Graeme Samuel, said that the ACCC has established "a framework for future price notifications that will encourage Australia Post to continue to reduce costs, improve productivity, and provide more certainty for Australia Post's customers."

Australia Post has proposed to bring the price rise into effect on 15 September 2008. Prices will also rise for large letters as well as small and large presort bulk mail.

A flow-on effect will be the welcome increase in some payments to Licensees.

Shadow Minister to address Melbourne meeting

Bruce Billson, the Shadow Minister for Broadband, Communications and the Digital Economy, has accepted our invitation to attend POAAL's Victorian Branch meeting in Melbourne on 14 August.

Application for Increase in Basic Domestic Postage Rate

In June, the ACCC released its preliminary view on Australia Post's application for an increase in the basic domestic postage rate.

POAAL has made another submission to the ACCC, this time in response to the ACCC's preliminary view.

AUSTRAC update

Despite offers by Australia Post and representations by POAAL, AUSTRAC has decided that Licensees will need to complete compliance reports. AUSTRAC has advised POAAL that Licensees will be circulated with information and forms, and that Australia Post will also be communicating with Licensees prior to the AUSTRAC material being sent out. Some Licensees may find all this paperwork a bit daunting, and if so please don't hesitate to get clarification from AUSTRAC.

It will mean extra work for some Licensees, which could be successfully and efficiently performed by AP's reporting processes. We will continue to monitor the situation and point out to the Government that the work can be performed by AP.

Life Membership recipients

Long-serving POAAL SA/NT members Rod Row and Dennis Jenner were awarded Life Membership of POAAL at the POAAL meeting in Adelaide on Sunday 22 June.

Rod Row has served as a Committee member and as SA/NT State Chairman. He is possibly best known for his very popular column "Rod Row's Handy Hints" which appeared quarterly in Postal News. In addition to his Committee duties, Rod has run POAAL LiPOMS Workshops around Australia. Rod and Chris Row recently sold their post office.

Dennis Jenner also served as a Committee member and as State Chairman. Dennis has continued to serve on the POAAL Board and has also run a number of POAAL LiPOMS Workshops around Australia.

POAAL's current SA/NT State Chairman, Chris Campbell, was proud to present Rod and Dennis with their Life Memberships. Two worthy recipients.

German post offices to be privatised

Deutsche Post, the German national postal operator, will sell its remaining 750 "corporate" post offices in the next three years.

By 2011, Deutsche Post will have a retail network consisting of 13,500 post offices, all operated privately or PostBank.

Deutsche Post is obliged by law to have a minimum of 12,000 postal outlets. The conversion of its 750 corporate outlets is part of its continuing overhaul of the German postal network.

Application for Increase in Basic Domestic Postage Rate

As previously advised, POAAL made a submission to the ACCC supporting Australia Post's application for an increase in the basic postage rate of 50c.

The ACCC has now released its preliminary view and we can report that the ACCC supports the application for an increase.

POAAL will be making a further submission to the ACCC following the release of the its preliminary view.

Proposed variation to LPO Agreement - update

Our thanks to those Licensees across three States who were quick to alert us to Australia Post's advice to Licensees regarding a proposed variation to the LPO Agreement.

This prompt action by Licensees enabled POAAL to seek legal advice and contact Australia Post without delay, pointing out the error of their ways in circulating this advice to Licensees.

Australia Post has agreed to write to the Licensees in those three States, advising them to destroy the original advice.

POAAL will be holding consultations in the near future with Australia Post.

POAAL will keep Licensees informed of any further developments.

Proposed changes to LPO Agreement

Some Licensees may have received a letter from Australia Post in the last few days, proposing changes to their LPO Agreement.

These changes have not been agreed to by POAAL and we have contacted Australia Post in this regard.

Licensees should not do anything at this stage. POAAL will advise when consultations with AP are completed.

Report on NSW Branch meeting

Tuesday night's NSW Branch meeting in Sydney was excellent. Three AP senior Australia Post managers were present, including the State Manager Commercial. They spoke on the present and future of the LPO network, and listened intently to the input of Licensees present. They agreed that they went away from the meeting with some good ideas and a better understanding of Licensees' needs - especially related to prompt responses by AP, stock availability and distribution, and product margins.

The questions flowed from the assembled Licensees and after the close of the meeting at 11pm, the Australia Post representatives stayed on for at least another half an hour talking individually to Licensees.

There might have been some bleary eyes at work on Wednesday morning, however all Licensees present welcomed the opportunity to have input from AP at a senior level, and are looking forward to an update meeting in a few months' time.

SA inquiry into franchising

The South Australian State Government has released its report on franchising.

POAAL made a detailed submission to this inquiry.

Several recommendations were made, which will interest Licensees and Franchisees.

World Postal Survey

This sixth World Postal Survey is now open. POAAL members are invited to take part and voice their opinions on the health and state of the postal world.

The survey has become a regular feature on the annual postal calendar as a barometer of confidence in the postal industry.

The World Postal Survey can be completed online.

Survey results will be announced in October.

PO Boxes - large sizes

Following representations by POAAL, it is pleasing to report that Australia Post has agreed to permit Licensees to install two new box sizes: A4 and Jumbo.

The A4 size is approximately half the size of a large box, and the jumbo size is approximately the size of two large boxes.

Licensees who have a market for these boxes should apply to their Area Manager for approval to install them.

Driver training - Melbourne, 30 April

POAAL, in conjunction with DECA Driver Training, is launching a new programme to help Mail & Parcel Contractors, and Licensees who transport mail, to improve their driving skills.

Learn how to improve your driving skills, reduce wear and tear on your vehicle, and save money!

This seminar is the first part of a two-part pilot training programme.

The first seminar is a "theory" session and is free to all POAAL members. Come along to this session on Wednesday 30 April to find out more. This first session will be treated as a pilot training course for POAAL members and there will be four complimentary places available to four of the POAAL members who complete the "theory" session.

AP application for increase in postage rates

POAAL has made a submission to the ACCC in support of Australia Post's application to the ACCC for changes to some postage rates, including an increase in the base domestic postage rate.

LiPOMS Data Collection Report

Licensees should regularly check the LiPOMS Data Collection Report for their LPO. Data from this report is used to determine some LPO payments.

Do you have a copy of the LiPOMS Data Collection Report for your LPO?

If not, have you written to AP requesting a copy of your LiPOMS Data Collection Report? Section 12.6.1 of the LPO Operational & Accounting Procedures makes provision for Licensees to request this report from AP.

Highlights of POAAL Conference Day 2

A visit to the State Parcel Centre and Australia Post's role in protecting Australia's borders were two of the highlights of Day 2 of the POAAL Conference.

Delegates visited two local LPOs prior to assembling at the State Parcel Centre in Kings Meadows for a guided tour. The tour covered not only operational aspects of the Centre but also some of the initiatives being undertaken locally to improve mail delivery performance. There was also an opportunity for delegates to put a pair of ULDs to good use!

A representative from AQIS gave a detailed presentation on the handling of inward international mail in Australia. Licensees and Contractors were given tips on how to identify suspicious mail items.

The Conference was a great success, and Delegates left with new business ideas, new business contacts, and new friends.

Highlights of POAAL Conference Day 1

ACCC Small Business Commissioner John Martin and Postal Industry Ombudsman Prof John McMillan were two of the keynote speakers at day 1 of the POAAL Conference in Launceston.

Commissioner Martin spoke on a range of topics, including amendments to the disclosure provisions of the Franchising Code of Conduct, the ACCC's role in the regulation of AP's reserved services and its role in monitoring AP.

Professor McMillan outlined the role of the Postal Industry Ombudsman in helping resolve disputes. Some of the major causes for complaint were discussed. Prof McMillan noted that the most painful complaints are those that are badly handled and that good complaint handling is good business sense.

Paul Letcher from Australia Post spoke on some of AP's initiatives to source new and diverse income streams.

Sharon Johnston, from Corporate Property, spoke on some of the problems and solutions available to Licensees who may be negotiating leases.

In workshops for Contractors held today, two of the major issues raised were increasing fuel costs and the inconsistency of implementation of the rural numbering scheme.

POAAL Conference kicks off in style

The 2008 POAAL Conference commenced this evening with an informal welcome reception at the Tasmanian Design Centre.

Delegates, exhibitors and guest speakers mingled amongst Tasmanian crafted works of art and design.

The Reception & Welcome function gave delegates an opportunity to meet and network in an informal setting. Many conference exhibitors were present, along with some of the conference's guest speakers.

LPO Premises

LPO premises is often a hot topic at POAAL meetings. How much space in your business does Australia Post want? How much floor space in your business should be allocated to Australia Post work? What is the balance between Australia Post-sourced work and other? How much space should you allocate for private boxes? How much signage can you use inside your premises? Where should you place the EPOS terminal and scales? Can non-AP billpay be transacted at LPOs? What do you do if AP wants to categorise your LPO as "stand alone"? (Stand alone LPOs may sell only AP-sourced products and services in the designated premises.) These and many other questions are posed by Licensees when considering how much of the floor space in their business should be dedicated to AP-sourced business.

Licensees should note that the floor space allocated for only AP-sourced business must be agreed between the Licensee and AP - it must not be imposed on the Licensee by AP. [Refer 1.2.1 and 1.2.2 of the LPO Manual.] When considering the allocation for defined AP floor space at their LPO, Licensees should consider many factors, including foot traffic, margins, staff and customer safety, security, mix of business and Protected Products (Annexure B of the LPO Agreement, 4.1.6 of the LPO Manual). Licensees wanting more information should contact their POAAL State Chairman, or come along to a POAAL meeting and ask the question.

Licensees should remember: it is your business and you know your customer mix, however Australia Post is a strong brand and can draw foot traffic for your entire business. Aim to achieve a good mix of business to give balance to your investment - this will help to reduce the impact of seasonal or other "ups and downs."

POAAL has prepared a sample letter for Licensees wanting to change their floorplan.

Prospective Licensees should look for the floor plan of the premises, which must be attached to the LPO Agreement provided by the Vendor and the Business Agent/Broker along with the Disclosure Document and other papers. A copy of the LPO Manual should also be provided.

New Licensees should be particularly careful to scrutinise any floor plan or changes to floor plans handed to them by AP. Do not simply sign any floor plan provided by AP before you have checked it carefully and considered the ramifications of any changes proposed by AP. Changes have the potential to limit your income. If you have any questions, ring a POAAL representative or check the implications with your solicitor before you agree to and sign the floor plan. Refer again to the LPO Manual 1.2.1.

Licensees selling their LPO should ensure that any changes to the floor plan demanded by AP as a condition prior to sale will not impact adversely on the business - this could have an impact on your sale price. If after discussion with AP there is no agreement on floor plan, then lodge an LPO11 to initiate the dispute resolution process.

POAAL meets with Shadow Minister for Small Business

POAAL representatives today met with the Shadow Minister for Small Business, Steven Ciobo MP, at the POAAL National Office.

The Shadow Minister was given an overview of the role of Licensees and Mail & Parcel Contractors and their small business needs. He is sympathetic to the issues facing small business owners, such as staffing and regulatory requirements.

He indicated that he is prepared to attend a POAAL Branch meeting and meet small business owners face-to-face.

Meeting with new Minister for Communications

POAAL national representatives met today with the new Minister for Broadband, Communications and the Digital Economy, Senator Stephen Conroy. Senator Conroy was re-briefed on the role of Licensees, Agents and Contractors and current matters of interest to them.

During his time as Shadow Minister for Communications, Senator Conroy was vocal in his commitment and interest in our members' business interests, and during our meeting with him today he reaffirmed his continuing interest in their circumstances now that he is Minister for Communications. POAAL welcomes this continuing commitment and will keep in regular contact with the Minister and his advisers, briefing them on matters pertinent to our members.

POAAL has invited the Minister to make a presentation at our national mini conference which is to be held over Easter in Tasmania, and he expressed his desire to attend, subject to other Ministerial commitments which may take priority. Licensees and Contractors who will be delegates at the conference would welcome the opportunity to meet and hear from the Minister, in particular his intentions regarding Australia Post and its LPO and contractor arms.

POAAL will hold a LiPOMS Workshop in Willunga on Tuesday 8 January 2008.

Canberra Christmas dinner - 7 December

Licensees and Mail Contractors in the ACT region are invited to a pre-Christmas dinner organised by POAAL for Friday 7 December 2007.

French postal service hit by strike

La Poste, the French postal service, has been affected by strikes by French public servants.

La Poste has estimated that up to 15% of its staff had walked off the job in support of the industrial action. Flights in and out of Paris Charles de Gaulle airport have also been affected by the strike, with delays of 30-45 minutes reported.

AaE to introduce new delivery portal

Australian Air Express has designed a new "online delivery portal" for its customers. The portal allows customers to enter pick-up and delivery details online and then print a label (including barcode) for the consignment which AaE drivers can scan upon collection.

AaE has been testing the scanning system since last year. It has a network of 1800 hand-held scanners across Australia.

The new online portal will also allow customers to track and trace their consignments.

Australian Air Express is a partnership of Australia Post and Qantas.

Labor commits to retain AP in public hands

Following the Minister for Communication's recent announcement that AP will remain in public hands under a Coalition Federal Government, Senator Stephen Conroy (Labor's Shadow Minister for Communications) has stated that AP will remain in public ownership under a Labor federal government.

Licensees and Contractors heard the Shadow Minister address the POAAL Branch Meeting in Sydney last Thursday, 8 November. He commented on the extraordinary work that Licensees and Contractors perform, from delivery mail to remote parts of Australia to providing over-the-couter retail services to their local communities.

Senator Conroy announced that not only is the ALP committed to retaining Australia Post in public ownership, the ALP will not further deregulate Australia Post.

During the course of his presentation, Senator Conroy touched on many issues of interest, including the relationship between AP and its Licensees and Contractors. He spoke with authority on issues facing Licensees and Contractors, and vowed to take an active interest in Australia Post should the ALP win government.

Senator Conroy announced that the ALP will institute a Petrol Commissioner at the ACCC, with responsibility for pricing and competition issues relating to petrol.

The Minister for Communications, Senator Helen Coonan, made a presentation at the POAAL NSW Branch meeting on 26 September. She noted Licensees' and Contractors' value to Australia Post.

Licensees: Have you been paid the correct OMPF on your Christmas stamps? Some Licensees have discovered irregularities in their delivery invoices from AP.

Check the OMPF that AP will pay you on your Christmas stamps. If you have been underpaid (or not paid at all) then contact your Area Manager immediately.

Political lobbying for this month's Federal Election

POAAL has prepared a pro forma letter that Licensees can use when lobbying their local member of federal parliament.

Make sure that politicians hear your voice during this federal election campaign. Write to your local candidates, the Minister for Communications, the Shadow Minister for Communications, and other politicians.

A pro forma letter can be downloaded from the POAAL website. If you wish, you can use the letter as a basis for your own correspondence to politicians, noting your own local issues as well as matters of national importance.

AP to remain in public hands

Senator Helen Coonan has emphatically confirmed that Australia Post will remain in public hands.

Senator Coonan, the Minister for Communications, IT & The Arts, addressed the POAAL Branch Meeting in Sydney last Wednesday, 26 September. The Minister's address covered topics such as the value of Licensees, Agents and Contractors to the operations of Australia Post, the Government's intention to ensure that all Australians have access to postal serevices, including small communities. She noted that LPOs and Community Agencies fill in the gaps in many rural areas as other businesses close.

Licensees and Mail Contractors warmly welcomed the Minister to their meeting and took the opportunity to ask pertinent questions after her presentation. The Minister and her Chief of Staff were given a clear picture of how Licensees and Contractors perceive the postal industry and their role in it.

The Minister agreed that it was worthwhile for her to take the time to talk directly with people who have invested in the Australian postal industry and noted her appreciation for their role in the community. She advised that the government is preparing to invest in the postal industry - Licensees and Contractors are keen for at least some of that investment to be in their sector.

The Australian Fair Pay Commission has announced that the standard federal minimum wage will increase from the first pay date on or after 1 October 2007.

Street addressed mail to PO Boxes

This issue has generated a large amount of mail and faxes to POAAL from sorely-tried Licensees all over Australia. The matter has been taken up with Australia Post and now AP is to trial a system in NSW which they hope will lead to a long term solution.

NSW Licensees participating in the trial are requested to carefully monitor the trial and note any improvements. We would appreciate it if Licensees would forward comments progressively to POAAL to enable us to continue to consult with AP so that we get it right before it is extended to other States.

Itella sales figures grow

Itella, the international mail and logistics arm of Finland Post, has recorded an increase in sales in second quarter results.

Itella has commenced operating new logistics centres in Moscow and in Kaunas, Lithuania. The company has also acquired a Swedish logistics company and a furniture business service operator in Finland.

Postal services are still provided under the company name "Posti" in Finland.

Trade Practices amendments

The Senate referred the provisions of the Trade Practices Legislation Amendment Bill (No. 1) 2007 and the Trade Practices Amendment (Predatory Pricing) Bill 2007 to the Standing Committee on Economics.

The Committee invited submissions on these two pieces of legislation.

POAAL provided the Committee with a detailed submission, which can be downloaded from the Parliament House website.

Inquiry into retail leases

The Australian Government asked the Productivity Commission to undertake an inquiry into the market for retail tenancy leases in Australia.

POAAL made a submission to the Productivity Commission, including information provided by a number of Licensees.

Workplace Relations Fact Sheet

Do you employ staff at your LPO? The Workplace Authority has published a Workplace Relations Fact Sheet. Employees are to receive a fact sheet to assist them in better understanding the workplace relations system, their entitlements, protections and where to go for information and advice. From 20 July 2007 it will be a legal requirement that all Australian employers provide the fact sheet to their employees.

Employers need to provide the Workplace Relations Fact Sheet to their existing employees before 20 October 2007. New employees must get one within seven days of starting work.

Royal Mail workers on strike

Postal workers in the UK will go on strike today. The dispute relates to pay and network modernisation.

This will be the first national postal strike in the UK for 11 years.

The UK's postal workers union, the CWU, called the action after turning down Royal Mail's offer of a 2.5 per cent pay increase. The CWU also fears that restructuring plans could mean up to 40,000 job losses.

Royal Mail said it could not afford a higher pay settlement and that it needs to make itself more efficient in response to increased competition in the postal market.

What can't be mailed to Australia?

Australian Quarantine has published an online guide to what can't be mailed to Australia.

AQIS checks goods arriving at international mail centres, airports and seaports. Quarantine officers, x-ray machines and detector dogs screen all of the 150 million items of international mail sent to Australia each year, intercepting around 80,000 high-risk items.

Express... by helicopter!

A new express courier service has been launched between New York City and major European destinations.

DHL Express has introduced a service for consignments being sent from the lower Manhattan district of New York City. The service includes transfer by courier to a helicopter pad, from where the consignments are flown by helicopter direct to JFK airport! From there consignments are loaded onto flights bound for nine cities in Europe.

The volume of consignments is such that a service like this is viable. The European destinations are Amsterdam, Brussels, Dublin, Frankfurt, Geneva, London, Madrid, Paris and Zurich.

AaE "reversals"

Licensees may have encountered instances of AaE transactions being reversed. POAAL has raised this issue at recent State and National meetings with AP.

AP is aware of the issue and is working with AaE to fix it.

Bag & Carded Article count

A Licensee member of POAAL has provided a spreadsheet that you can use to count bags and carded articles at your LPO.

The spreadsheet can be downloaded from here as an Excel file. You can then enter the daily totals and keep track of bags despatched from and carded articles received at your LPO.

Australia Post not for sale

The Federal Government has today noted that it has no plans to sell Australia Post. This statement follows speculation fuelled by CommSec's valuation of Australia Post at up to $7 billion.

A report from CommSec noted that a strong case could be made for the sale of Australia Post. Articles covering the report were published in some newspapers today, including The Age.

A spokesperson for the Minister for Communications, IT & The Arts, Senator Helen Coonan, today said that the Federal Government has no plans to sell Australia Post. (As reported in The Age online today.)

The Shadow Minister for Communications & IT, Senator Stephen Conroy, today released a statement noting that the ALP is committed to retaining Australia Post in full public ownership.

Australia Post appeared before the Senate Estimates Committee on 23 May. Representatives from Australia Post were quizzed by Senators on a number of matters, including fuel price rises, greenhouse gas emissions, PO Boxes and security equipment at LPOs.

The LPO Arrangements Payment Scheme is a document that shows payment rates for Licensees and includes explanatory notes for payments.

At the POAAL LiPOMS workshops held around Australia over recent months, Licensees have asked how to better understand the LPO payment system. A good place to start is with the LPO Arrangements Payment Scheme.

LiPOMS Data Collection Report

Licensees should regularly check the LiPOMS Data Collection Report for their LPO. Data from this report is used to determine some LPO payments.

Do you have a copy of the LiPOMS Data Collection Report for your LPO?

If not, have you written to AP requesting a copy of your LiPOMS Data Collection Report? Section 12.6.1 of the LPO Operational & Accounting Procedures makes provision for Licensees to request this report from AP.

POAAL sent a pro forma letter to all Licensees that can be used to request a copy of the LiPOMS Data Collection Report for their LPO.

Deutsche Post looks to the future

Deutsche Post World Net (DPWN) has published detailed financial results for 2006. DPWN is the parent group for Deutsche Post, DHL, and Post Bank.

Most of DPWN's profit comes from its mail operations. In 2006, €2b of the group's EBIT came from its mail operations. However, DPWN has forecast that this business will decline over time as demand for postal services declines.

DPWN is now looking to its logistics operations to increase profitability in order to meet growth and profitability targets in the future.

ACCC report into AP cross-subsidy

The ACCC has released its report assessing cross-subsidy in Australia Post.

The report presents the results of the ACCC’s analysis of Australia Post for the 2005–06 financial year to determine whether or not it is cross-subsidising from its reserved services to its non-reserved services.

Australia Post has recently sent instructions and a questionnaire to many Licensees regarding the delivery of eParcels from a particular contract customer.

Licensees are reminded that under the terms of their LPO Agreement, they are not required to leave the LPO to deliver any mail items at any time.

What a weekend!

Fantastic speakers, valuable workshops and the sensational seventies! POAAL's 2007 Conference in Christchurch had them all.

Licensees and Mail Contractors from all over Australia gathered in Christchurch, New Zealand, for POAAL's 2007 Conference. Joining Australian delegates were a few locals who operate NZ Post Franchised PostShops.

Conference highlights included site visits to NZ Post's new mail centre in Christchurch and to a few local post offices, Graeme Halperin's presentation on capital gains tax and superannuation and a presentation from a representative of the Postal Industry Ombudsman.

POAAL Conference only days away!

Licensees and Mail Contractors from across Australia are packing their bags for the POAAL Conference being held in Christchurch, New Zealand!

And delegates from New Zealand will be joining the Australians in Christchurch for this world-first international post office owners conference.

Guest speakers include leading solicitor Graeme Halperin, insurance broker Cameron Bott and a representative of the Postal Industry Ombudsman. The Secretary of the NZ Post Franchisees Association will also be making a presentation.

Exhibitors include Nation Wise will kits, Ambrosia retail products, and insurance brokers GWS Genco Group. There will also be a display of the latest mail sorting equipment technologies.

Another highlight for New Zealand and Australian conference delegates will be the site visit to NZ Post's new mail centre in Christchurch, where the brand new mail sorting machines will be demonstrated. There will also be visits to local franchised Postshops.

And, of course, there will be one of POAAL's popular LiPOMS Workshops!

Deutsche Post focuses on innovation

Deutsche Post World Net has opened its new "Innovation Centre" in Germany. The Centre has been set up to develop innovative products for the postal and logistics industry.

Projects at the Centre will be conducted jointly with business partners such as IBM, Intel and SAP.

One of the Centre's current projects is a robot that can unload delivery vehicles, and that can recognize different sized packages, pick them up and place them on a conveyor belt.

Deutsche Post World Net is the parent company of Deutsche Post, DHL and Postbank.

New "delivery intercept" service

UPS has launched an interesting new service called "Delivery Intercept" which is a new add-on service for track-and-trace shipments.

Delivery Intercept allows the sender to intercept and re-route packages before they have been delivered. The service is only available to UPS customers shipping products within the USA and Puerto Rico.

Packages can be intercepted even after a package has been loaded onto a UPS delivery vehicle!

It will be interesting to see if Australia Post or other national postal corporations offer a similar service for track-and-trace parcels. It could be a premium service, possibly the next level up from Express Post Platinum.

3 LiPOMS Workshops in April!

Several hundred Licensees have already attended POAAL's recent series of Learning about LiPOMS workshops at various locations around the country. The overwhelming response from Licensees to these meetings has highlighted Licensees' desire to get a clearer understanding of LiPOMS and their own LiPOMS monthly Statements.

Many Licensees were stunned to learn that they have been missing out on payments such as Line 39 and FaxPost payments.

It is important that all Licensees possess a copy of the Licensed Post Office Arrangements Payments Scheme, and regularly obtain from AP a copy of the LiPOMS Data Collection Report for their LPO. It is important that Licensees check this Report regularly.

POAAL urges all Licensees to take the time to become familiar with the procedure for obtaining payment for the LPO work performed. The LPO is a big financial investment and Licensees should ensure that they are receiving maximum payments (fees, commissions and discounts) from AP.

Mt Gambier LiPOMS workshop

POAAL Conference - still time to book!

POAAL's 2007 Conference will be held in Christchurch, New Zealand, over Easter. That's 7 & 8 April, 2007.

Solicitor Graeme Halperin will make a presentation on capital gains tax and superannuation reforms. Graeme has made presentations at previous POAAL Conferences - he has in depth experience of the postal industry (in particular LPOs and Mail Contracts) and his presentations are always interesting and thought-provoking.

A representative of the Postal Industry Ombudsman (PIO) will make a presentation at the Conference. The PIO was launched last year and it will be interesting to hear of how the introduction of an industry-specific ombudsman will impact on the postal industry in Australia.

There are two social events as well - a Welcome Reception on the Friday night and the Conference Dinner on the Saturday night. POAAL's Conference Dinners are always affairs to be remembered!

LiPOMS Workshops - 25 March

POAAL is pleased to announce that three LiPOMS Workshops will be held in NSW and Victoria on Sunday 25 March.

The recent LiPOMS Workshops held around Australia were hugely successful, with hundreds of Licensees discovering payments that they had not previously been claiming.

Now three more LiPOMS Workshops have been arranged for Sunday 25 March.

Echuca, Victoria

Workshop will be held at the Echuca Workers & Sports Club, commencing at 11am.

The workshop will be presented by Victorian Committee member David Rees, who co-ordinated the workshops recently held in Melbourne. Licensees from Victoria and NSW are welcome.

Orange, NSW

Workshop will be held at the Orange RSL, commencing at 1pm.

The workshop will be presented by POAAL Board member Bob Chizzoniti. Bob was part of the POAAL team that negotiated these payments.

Armidale, NSW

Workshop will be held at the Armidale Ex-Services Memorial Club, commencing at 11am.

Experienced NSW Committee member Les Slack-Smith will present the workshop.

Licensees should bring their monthly LiPOMS statement, a copy of Annexure A and the June 2006 LiPOMS report.

LiPOMS Workshops

Several hundred Licensees have already attended POAAL's recent series of Learning about LiPOMS workshops at various locations around the country. The overwhelming response from Licensees to these meetings has highlighted Licensees' desire to get a clearer understanding of LiPOMS and their own LiPOMS monthly Statements.

Many Licensees were stunned to learn that they have been missing out on payments such as Line 39 payments.

It is important that all Licensees possess a copy of the Licensed Post Office Arrangements Payments Scheme, and regularly obtain from AP a copy of the LiPOMS Data Collection Report for their LPO. It is important that Licensees check this Report regularly.

POAAL urges all Licensees to take the time to become familiar with the procedure for obtaining payment for the LPO work performed. The LPO is a big financial investment and Licensees should ensure that they are receiving maximum payments (fees, commissions and discounts) from AP.

More workshops are planned, included a special session at the POAAL Conference at Easter. Further details are available from POAAL.

Rapidly rising rents

POAAL has been alerted to a number of instances in NSW and Queensland where Licensees have been subject to massive rent increases at their LPO.

Because of the serious adverse impact on net income at affected LPOs, POAAL has taken up this matter with Australia Post at a national level, urging Australia Post to implement a consistent national policy to assist these Licensees. POAAL has strongly suggested to AP that the eligibility for Rent Subsidy be reviewed. There may be some creative solutions available, such as AP providing assistance to Licensees who have to move premises from a high rent to a lower rental location.

LPOs in mining areas

A number of Licensees at LPOs in mining areas are experiencing severe difficulties in finding and retaining staff to work in their LPO (or on their mail contract, in some cases). The higher wages offered by the local mines are tempting counter and delivery staff away from LPOs. It is impossible for Licensees to match the wages offered by the mines and still maintain the profitability of the LPO.

POAAL has met with Australia Post to raise this issue. Licensees in these areas are facing some tough business decisions.

NSW Christmas meeting

POAAL's NSW Branch is holding a meeting for Licensees in Sydney on Sunday 10 December 2006.

New Award rates

The Australian Fair Pay Commission has responsibility for setting and adjusting
minimum wage rates within the federal jurisdiction. It recently handed down its decision on Minimum Wage Rates. (More information on the decision can be found at www.fairpay.gov.au.)

This decision applies only to certain Licensees who pay staff under the Postal Services Industry Award. Refer to the WorkChoices website for further information.

The Commission approved an increase of $27.36 per week which translates to a 72c per hour increase in all Australian Pay and Classification Scales (Pay Scales) up to and including $700 per week.

For the Postal Services Industry Award, the new rates will be:

PSO Level 1
Weekly rate $570.86
Hourly rate $15.02

PSO Level 2
Weekly rate $605.56
Hourly rate $15.94

Casual loading remains at 20%.

The increases take effect from 1 December 2006 (commences midnight
30 November).

This does not apply to employees covered by Australian Workplace Agreements (AWAs) or certified agreements approved prior to the commencement of Work
Choices.

International wine lodgements

Australia Post SA/NT recently sent a bulletin to all Licensees in SA/NT regarding Express Courier and Express Post International Wine Lodgements.

Under "Action to be taken", Licensees were instructed to photocopy each form twice. POAAL reminded AP that many Licensees do not have photocopiers, and those that do would probably charge AP for use of the photocopier!

AP has since responded to POAAL, noting that the situation has been rectified and that Licensees are not expected or required to photocopy on behalf of AP.

This matter was raised by the POAAL SA/NT State Committee.

eParcels

Many Licensees have queried Australia Post's recent instructions regarding the delivery of certain contract eParcels.

Licensees are reminded that under the terms of their LPO Agreement, they are not required to leave the LPO to deliver any mail items.

Any queries about this should be directed to your POAAL State Chairman in the first instance.

Inspect your file

Check out your file held by Australia Post

Licensees: Have you made an appointment with Australia Post to look at your file?

AP keeps files on all Licensed Post Offices and Licensees. When POAAL negotiated the LPO Agreement we insisted that it contain a clause to enable Licensees to check the accuracy of the content of the material held by AP in individual Licensees' files.

It's certainly worth checking. Find a date that suits you, give AP one day's notice and go in and have a look at it.

Don't be put off by AP - they are obliged to permit you this access. Check it carefully to make sure that it contains everything that you believe it should and that the material is accurate. What should you be looking for?

  • AP's copy of your LPO Agreement
  • Any updates and special conditions to your LPO Agreement
  • Copies of correspondence and notices to you from AP
  • Correspondence from you to AP
  • The same applies for emails and faxes
  • Internal memos/emails/reports etc regarding your LPO
  • Anything relating to you and your LPO since you became the Licensee

The clause of your LPO Agreement that relates to this is Clause 15c. Check your LPO Agreement and know your rights.

Fair Pay Commission decision

The Australian Fair Pay Commission recently handed down its decision on Minimum Wage Rates. More information on the decision can be found at www.fairpay.gov.au.

This decision will impact upon some Licensees who pay staff under the Postal Services Industry Award. The Commission approved an increase of $27.36 per week which translates to a 72c per hour increase over the previous Award rate. The new Rates do not take effect until 1 December 2006.

Remember that a 20% loading applies for Casual Staff.

Record keeping rules for Australia Post

In August the ACCC released its first report on whether or not Australia Post is subsidising its competitive activities from its monopoly activities.

Following the release of this first report on potential cross-subsidisation within Australia Post, the ACCC again asked POAAL for comments with regard to what information must be disclosed by AP. In the ACCC's report, some information was withheld because AP deemed it to be commercial-in-confidence. The ACCC sought comment on the appropriate level of disclosure with regard to information AP deems to be confidential.

Disclosure documents

Licensees: Do you have an up-to-date copy of the disclosure document as it applies to your LPO?

Each year, Australia Post is obliged under the Franchising Code of Conduct to provide a disclosure document to Licensees. Under the terms of the Franchising Code of Conduct, AP is required to provide disclosure documents to existing franchisees (Licensees) within 14 days of request. The disclosure document must be updated annually, within three months of the end of the financial year.

This means that AP must have an up-to-date disclosure document prepared for your business by 30 September each year. Licensees should request an up-to-date disclosure document from AP each year. By requesting the disclosure document at the beginning of October you will guarantee that you will receive the most recent disclosure document relating to your business.

Some of the information included in the disclosure document includes:

  • details of the franchisor (Australia Post), including the business experience of Australia Post management
  • any plans AP may have to establish another outlet nearby
  • details of any litigation involving Australia Post

Mark it on your calendar - request a disclosure document annually from Australia Post.

Drug & Alcohol dependency programme

POAAL wrote to Australia Post requesting access for Licensees to AP's Drug & Alcohol Dependency Programme. The programme is currently in place for AP corporate employees.

AP has denied our request to allow Licensees access to the AP Drug & Alcohol Dependency Programme.

It is disappointing that AP has taken this stance. While we hope that there is never any cause for a Licensee to require assistance through such a programme, it could offer Licensees a helping hand if they ever found themselves in trouble.

POAAL will continue to press AP on the matter.

Whistleblower policy

Following Australia Post's introduction of a whistleblower policy for corporate staff, POAAL has been pushing for Licensees to be covered by the Australia Post Whistleblower Policy. AP has confirmed to POAAL that it has extended the Whistleblower Policy to include Licensees and their staff.

The whistleblower policy will provide a process for Licensees to report suspected illegal or improper conduct within AP. AP has distributed information on the policy to all Licensees and CMAs.

It is pleasing to see AP including Licensees in this field.

ACCC report into AP cross-subsidissation

The ACCC has released its first report on whether or not Australia Post is subsidising its competitive activities from its monopoly activities. The report found no evidence of such cross-subsidisation.

One of the ACCC's responsibilities with regard to Australia Post is to monitor for the presence of cross-subsidies between Australia Post's reserved and non-reserved services.

To assist it in undertaking these roles, the ACCC can issue 'record keeping rules' to Australia Post, thereby requiring Australia Post to keep the records specified and provide them to the ACCC.

The record keeping rule provisions were introduced to the Australian Postal Corporation Act 1989 by the Postal Services Legislation Amendment Act 2004, and, while one of the primary intentions of introducing these powers was to address concerns about cross-subsidisation, the ACCC may require Australia Post to keep records that relate to any of its regulatory roles.

The ACCC may prepare and publish reports analysing the information provided to it under the record keeping rules and the Minister may direct the ACCC to prepare and publish reports analysing the information provided to it under the record keeping rules.

The record keeping rules were developed following consultation with POAAL, Australia Post, and other bodies. POAAL's submissions were quoted extensively in the ACCC's recently published Preliminary Views.

In the ACCC's report, some information was withheld because AP deemed it to be commercial-in-confidence. The ACCC is now seeking comment on the appropriate level of disclosure with regard to information AP deems to be confidential.

Submission to Fair Pay Commission

POAAL recently made a submission to the new Australian Fair Pay Commission on behalf of its members. POAAL called for any decisions made by the Commission to take into account the needs of small business owners such as Licensees.

Licensees play an important role in their communities, not just supplying services but also providing employment.

Official launch of PIO

The Postal Industry Ombudsman (PIO) was today launched in Sydney by Senator Helen Coonan, the Minister for Communications, IT and the Arts. (pictured left) POAAL was officially invited to the launch, and was represented by NSW State Chairman, John Dixon.

The Ombudsman, Prof. John McMillan, and Australia Post's Managing Director, Graeme John (pictured below), spoke at the launch.

"The Postal Industry Ombudsman will be a recognisable, dedicated, experienced and independent entity to help maintain high standards in our postal system and ensure it meets the future needs of consumers," Senator Coonan said.

Prof. McMillan commented that the number of representatives from the postal and courier industry attending the launch augurs well for the Postal Industry Ombudsman function and industry acknowledgement of the benefits of an association with the Ombudsman's office.

The PIO was established following extensive consultation, including submissions from POAAL. It was pleasing to see that many of POAAL's suggestions were incorporated into the PIO model. The PIO will start operations later in 2006.

It is POAAL's hope that the PIO will lead to an even more reliable and professional postal service in Australia.

LPO Premises

LPO premises is often a hot topic at POAAL meetings. How much space in your business does Australia Post want? How much floor space in your business should be allocated to Australia Post work? What is the balance between Australia Post-sourced work and other? How much space should you allocate for private boxes? How much signage can you use inside your premises? Where should you place the EPOS terminal and scales? Can non-AP billpay be transacted at LPOs? What do you do if AP wants to categorise your LPO as "stand alone"? (POAAL doubts that there are any true "stand alone" LPOs in Australia as all would provide some non-AP sourced products/services, even if only a fax service.) These and many more questions are posed by Licensees when considering how much of their floor space should be dedicated to AP-sourced business.

Licensees should note that the floor space allocated for only AP-sourced business must be agreed between the Licensee and AP - it must not be imposed on the Licensee by AP. When considering the allocation for defined AP floor space at their LPO, Licensees should consider many factors, including foot traffic, margins, staff and customer safety, security, mix of business and Protected Products (Annexure B). Licensees wanting more information should contact their POAAL State Chairman, or come along to a POAAL meeting and ask the question.

Licensees should remember: it is your business and you know your customers, however Australia Post is a strong brand and often draws foot traffic for your entire business. Aim to achieve a good mix of business to give balance to your investment - this will help to reduce the impact of seasonal or other "ups and downs."

New Licensees should be particularly careful to scrutinise any floor plan handed to them by AP. Do not simply sign any floor plan provided by AP. If you have any questions, ring a POAAL representative or check the implications with your solicitor before you agree to and sign the floor plan.

Licensees selling their LPO should ensure that any changes to the floor plan demanded by AP as a condition prior to sale will not impact adversely on the business - this could have a negative effect on your sale price.

Franchising Code online

The Australian Competition and Consumer Commission (ACCC) has responsibility of administering the Franchising Code of Conduct and investigating potential breaches of the Code. It has also had success in facilitating discussion between franchisees and franchisors to resolve problems, avoiding the potential for matters being escalated to a point where breaches of the Act arise.

Licensees and prospective Licensees can find information on the Franchising Code of Conduct available on the ACCC's website. The ACCC has an online guide to the Code available at the ACCC website. The online guide includes information for franchisees, the role of the ACCC, and various publications.

2007 Conference announced

POAAL is holding its 2007 Conference in Christchurch, on New Zealand's South Island. The Conference will be held over Easter 2007 - on Saturday 7 & Sunday 8 April 2007.

This will be POAAL's first-ever overseas conference. Not only that, but the 2007 Conference is open to all private owner/operators of post offices in Australia, New Zealand and the United Kingdom. This will be the first time ever that an international conference is being held for Australian Licensees, NZ Franchisees and UK Subpostmasters.

The Conference will take place in Christchurch on Saturday 7 April and Sunday 8 April. A reception and welcome drinks will be held on the evening of Friday 6 April, and a dinner on the night of Saturday 7 April. Delegates can bring guests to the Reception function and the Dinner.

The Conference programme, including details of guest speakers, will be released later, and will include site visits to local post offices.

Why not take a longer break and do some pre-and post-conference touring in New Zealand?

Delegate registration forms will be sent to all POAAL members, including more details on the Conference Dinner and accommodation.

ATMs in manual LPOs

Banking services are a protected product under Annexure B of the LPO Agreement. However, for some years, POAAL has been lobbying AP to allow ATMs to be installed in small manual LPOs, especially where there are no other banking services available to customers in the area and no likelihood of EPOS facilities being installed at the LPO.

Many small country communities are disadvantaged because of the lack of local electronic banking services. In response to customer demand, many Licensees at manual LPOs in rural and remote areas in particular have been asking POAAL to represent their interests to Australia Post.

Although our discussions have obviously been confidential, it is pleasing to now be able to report that these discussions have finally borne fruit.

A response by Australia Post to a recent Senate Estimates question on this subject indicates that where a Licensee at a manual LPO applies to AP for approval to install an ATM, AP would in most cases approve the application.

Postal Industry Ombudsman

Legislation establishing the Postal Industry Ombudsman (PIO) was passed by Federal Parliament on 29 March 2006. The PIO will provide a mechanism for customers to resolve disputes with Australia Post, and possibly customer complaints against other postal operators.

Representatives of the PIO recently addressed a meeting of the POAAL Board, which provided an excellent opportunity to discuss how the PIO will interact with Licensees and Contractors. A report will be published in Postal News.

The first discussion paper regarding a PIO in Australia was published in 2002, and POAAL has supported the concept from the beginning. POAAL made a detailed submission in response to the discussion paper. It was pleasing to see that many of POAAL's suggestions were incorporated into the PIO model.

It is POAAL's hope that the PIO will lead to an even more reliable and professional postal service in Australia.

Mail2Day Commissions

Licensees have noted that Australia Post offered renewing PO Box customers 12 months of the Mail2Day service for the price of 9 months.

In response to a query from POAAL, AP has advised that the Licensee will still receive the full commission under this scheme.

PO Box renewals

POAAL has received many complaints from Licensees regarding the performance of the new PO Box system during the hectic Box renewal season. Licensees will be pleased to know that AP has been carrying out a thorough review of the system over recent weeks. POAAL provided input last month on a number of aspects of the system that were causing significant concerns to Licensees.

AP has advised POAAL that extra computer power has been installed to better cope with demand during peak times. AP has also extended the period for closing off boxes because of the lateness in distributing PO Box renewal notices.

POAAL is of the opinion that a major technology and operational change such as this should be thoroughly tested prior to implementation. It is a sound industry practice that should be replicated in these instances.

Variation to Postal Services Award

A hearing was held in the Australian Industrial Relations Commission today regarding the CEPU's application to vary the Postal Services Industry Award to reflect the Family Provisions Test Case Decision. POAAL was at the hearing representing Licensees' interests.

The Family Provisions Test Case Decision was made by the full bench of the AIRC in 2005. It affects the way that employees can take various forms of leave, such as personal leave and annual leave.

POAAL met with the CEPU prior to the hearing to discuss the CEPU's application. At that meeting it was ensured that the variation to the Award kept the spirit of the existing Award. Following that meeting, the CEPU agreed to make some amendments to their application to vary.

At today's hearing, held in Melbourne, POAAL again emphasised the issues surrounding staffing in LPOs, especially the difficulty many Licensees have in finding reliable relief staff.

The Commissioner ruled that the variation complies with the Test Case ruling and that the Award will be varied according to the CEPU's application.

The variation to the Award will have no effect on casual employees. There should be negligible impact on part- and full-time employees.

The amended Award will be available on Wagenet (www.wagenet.gov.au) in due course. Don't forget that Licensees can sign up for free updates on the federal Postal Services Industry Award at the Wagenet website.

Sands of Gallipoli tops expectations for fundraising

Australia's Sands of Gallipoli collectibles have officially generated $400,000 in revenue for the country’s Returned & Services League of Australia (RSL), and is well on its way to exceeding expectations for fund raising for 2006.

The RSL national president Major General Bill Crews said "The RSL is pleased to support the Sands of Gallipoli initiative and will receive a 10% donation from Market Link Solutions on all sales of the products. These funds will support the RSL's ongoing welfare work in the veteran community." General Crews accepted the latest funds in November 2005 - just over $132,000 - at a ceremony held in Canberra.

The special Sands of Gallipoli collectibles are the brainchild of a Canberra company, Market Link Solutions. They include lapel pins, key rings, medallions, teaspoons, and plaques which contain authentic sand from ANZAC Cove.

Managing Director of Market Link Solutions, Stephen Davie, says, "We expect to surpass our target for 2006 fundraising thanks to the many thousands of Australians commemorating the ANZAC Spirit by raising money for the RSL. Our goal for this year is to raise $150,000. We're well on our way with over a $40,000 donation earmarked from early orders placed by clients, with this years donation we will exceed the $500,000 mark."

Australians have purchased over 130,000 Sands of Gallipoli items since they were introduced in 2003. Last year the most popular item has been the Limited Edition set of six commemorative medallions that depict key stages in the Gallipoli campaign. Carded articles payment

At meetings held during the recent POAAL Licensee Get-Together Weekend, many Licensees asked about the Carded Articles Payment.

Some Licensees may deliver a large number of carded articles over the counter every week of the year. A payment for excess carded articles (in excess of 25 per week) may be negotiated with Australia Post.

There will be an item in the 1st Quarter edition of Postal News explaining the procedure.

(AIRC) to vary the Postal Services Industry Award.

The CEPU's application follows a recent AIRC ruling regarding family provisions.

The variation hearing is scheduled to be held in Melbourne on 3 March 2006. POAAL will be present, as always, representing Licensees at the AIRC hearing in March.

Licensees affected by the CEPU's application do not need to take any action in relation to the hearing at this stage. POAAL will keep Licensees informed of proceedings, including the outcome of the hearing.

Commitment by Australia Post

The current issue of Business Review Weekly (BRW, Jan 19 - Feb 22, 2006) features franchising. One of the featured retail networks was Australia Post's proposed franchised postshop concept. It makes for interesting reading.

Australia Post, POAAL and the CEPU were all interviewed for the article. A quote from a senior Australia Post manager will be of major interest to Licensees. Mr Bill Mitchell, General Manager Commercial, is quoted as saying, "For example, we will not locate a franchised outlet in an area that would adversely affect a corporate or licensed outlet."

This commitment by Mr Mitchell will be welcomed by Licensees.

ACCC submission now online

POAAL has made submissions to the ACCC in response to the ACCC's request for submissions regarding the public disclosure of record keeping information received from Australia Post. The ACCC invited POAAL to make submissions on this matter.

Big Pond buy one get one free

Another good result for Licensees thanks to POAAL.

A number of Licensees contacted POAAL in regard to the "Great Brands at
Great Prices" catalogue, which was due to commence today. Included in the
catalogue is a "buy-one-get-one-free" promotion for Big Pond dial-up. Some
Licensees had been advised by Australia Post that they could take part in
this promotion, however the cost of supplying the free product was to be
borne by the Licensee!

POAAL raised this matter with Australia Post at a national level. Following
our representations, Australia Post has advised us that Licensees can
participate in this promotion, and that Licensees will be recompensed for
the buy-one-get-one-free offer. Australia Post headquarters has advised
their State counterparts of this decision.

Legal aspects of buying and selling a franchise

LEGAL ASPECTS OF BUYING, RENEWING, EXTENDING AND SELLING ANY FRANCHISE

Introduction - Buying, extending, renewing, or selling any Franchise will affect your life for future years. Parties must be aware of legal issues involved in such a transaction and recognise that both Franchisees and Franchisors have justifiable business interests to protect. Franchisors must know what they are selling and a potential Franchisee must know what they are buying. A Franchisor must also determine the most advantageous structure of ownership to operate the business. This article aims to address some prevalent issues and common problems relating to Franchising.

Disclosure - A minimum level of disclosure is required by the Trade Practices (Industry Codes – Franchising Regulations 1988) (the “Code”), aimed to provide information to the Franchisee in order to allow them to make an informed decision based on accurate information on whether to become involved in a Franchise. A Disclosure Statement must be provided by the Franchisor to the prospective Franchisee at least fourteen (14) days before entering into the agreement. It must contain details and experience of the Franchisor, litigation that the Franchisor is a party to, fees and costs, intellectual property, and goods and services you must acquire or provide.

A Franchisor must not make misleading or deceptive statements. The law provides remedies against such behaviour including a claim for damages and other remedies including some under the Federal Trade Practices Act or the relevant State or Territory's Fair Trading Act. Further, any breach of the Code is enforced under section 51AD of the Trade Practices Act 1974.

Documentation - Any sale, renewal, extension and/or purchase should be detailed in writing in a Franchise Agreement identifying what is expected from each party, including what they must do, how much and when they must pay and what is being transferred. It may be necessary to have completion of the Contract subject to various conditions such as cooling off, finance, liquor licensing, and transfer of lease, minimum trading levels over a period of time and/or the satisfaction of the Franchisee’s accountant with the financials of the Franchise.

Training and/or Operations Manual – Franchisors generally provide manuals to assist with the operation, management and training. These documents must be consistent with the Franchise Agreement. And should be a useful resource for all parties.

What is being transferred? - Components of a Franchise usually include names, goodwill, premises (lease or ownership), equipment, machinery and fixed assets, stock, current orders, supply agreements, intellectual property, and licenses. The Franchisor must be able to guarantee the transfer of the ownership of all components to the Franchisee. When negotiating a price for a Franchise, consideration of the plant and equipment, location of premises, goodwill and stock are vital. It may be necessary to seek an independent valuation of the business.

Fees - A Franchise may consist of various fees. These fees may include a royalty, sign on/establishment, marketing, advertising, training, management and software licence fee.

Industry Requirements - It is important to ensure a Franchisee is aware of industry and general requirements affecting the Franchise. Appropriate industry bodies, existing Franchisors or the local council may be helpful in obtaining additional information.

Franchise Territory - It must be determined prior to commencement of the Franchise whether the Franchisee is granted an exclusive or non-exclusive territory, be limited to a particular site, or may operate a business which is substantially the same in a certain defined area.

Term and Termination of a Franchise Agreement – The term of a Franchise Agreement will vary from one Franchise to another. There may also be an option to renew the arrangement for a further term. This will generally be addressed in the Franchise Agreement. Termination may be by either agreement or assignment (subject to Franchisor consent). The arrangement may also be terminated if the Franchisee no longer holds relevant licences or permits on expiration of the term of the Agreement.

Remedies - The Code provides a mediation process between the parties if there is a dispute. Due to the time and cost involved, litigation should be seen as a last resort. Apart from contractual remedies available to both the Franchisor and Franchisee, various provisions of the Code and Trade Practices Act prescribe various remedies such as injunction or making orders varying or refusing to enforce the agreement and list several offences.

Conclusion – Buying, extending, renewing or selling a Franchise is exciting yet inherently involves risk. What may appear simple can often end in financial and legal hardship. Whether as a buyer or seller, it is strongly recommended that advisers including accountants and lawyers are involved in the process, to ensure rights and obligations are respectively protected and honoured.

AP's "franchised postshop" proposal

Australia Post has circulated a Licensee Information Bulletin extolling its "franchised postshop" proposal. AP has also advertised in many major newspapers, calling for expressions of interest in their new proposal.

  • Does AP have any "franchised postshops" to sell?
  • Will AP convert its corporate post offices to "franchised postshops"? Unlikely.
  • Will many Licensees be shortsighted enough to convert to franchised postshop operations? Unlikely.
  • Will many Licensees sell their LPO to AP so that it can be converted and re-sold? Unlikely.
  • Will "franchised postshops" be as profitable as LPOs? Unlikely.
  • Will AP try to sell its four franchised postshop "pilot" sites? Probably.

Licensees who are invited to an AP "Information session for Licensees" do not have to attend. This invitation appears to be targeting tier 1 LPOs in metro and regional areas. AP claims that Licensees "will be under no obligation" and that "there will be no pressure from Australia Post for a Licensee to be involved in this program", however we understand from the calls we've received that some Licensees may feel under an obligation and under pressure.

    Our advice to Licensees in regard to franchised postshops is:
  • THINK ONCE
  • THINK TWICE
  • THINK AGAIN
  • Ring your POAAL State Chairman to discuss it

If someone from AP visits or calls you and tries to convince you that the "franchised postshop concept" is right for you, listen carefully but make no commitment. You could probably benefit from some legal advice.

Licensees will note in the AP bulletin the word "voluntary" in relation to LPO buybacks. That means that you cannot be forced into it. It is difficult to see any benefits of changing from an indefinite term, protected Licensed Post Office Agreement to a limited term franchising agreement where AP has all the control.

Protect your investment in your LPO. Don't let yourself be pressured by AP - call your POAAL State Chairman if you have any queries.

Business insurance for your LPO

Is your business insurance ready for renewal? A number of Licensees who have recently taken out business insurance for their LPO have advised POAAL that they have unwittingly renewed for less than a year, and thus their premium has looked more attractive than it really is.

Licensees should carefully check the paperwork received from any insurer, ensuring the sums insured and levels of cover meet your requirements. Pay special attention to the period of insurance, whether the policy runs for a full 12 months or for a shorter term. You may think you have purchased a cheap product whereas, in fact, it is the policy period that reduces the premium. The insurance broker must point out the policy period.

New EPOS screens and PIN pads

Following a recent POAAL Newsletter announcing the new EPOS PIN pads, POAAL was asked by a number of Licensees if the new EPOS PIN pads would be affected by interference from mobile phones. AP has advised that the new PIN pads meet the relevant Australian/NZ standards for radio disturbance levels.

AP has also provided POAAL with further details on the disposal strategy for the EPOS monitors and PIN pads that are to be replaced. The strategy is for zero landfill. To achieve this, AP will first maximise re-use of the old equipment and then to recycle. Working models will be sold and non-working models will be sent to an accredited disposal operator who will break them down into the main categories of glass, metal, plastic and electronic components for recycling.

It is pleasing to see that AP has adopted an environmentally-friendly disposal strategy.

Mail volumes for US Postal Service

The US Postal Service recently announced that its total mail volume for July 2005 was 227 million articles. This is 1.4% lower than July 2004. Overall this year, mail volumes in the USA have increased by 2.6%.

This corresponds with a study by US firm Pitney Bowes ("Electronic Substitution for Mail: Models and Results; Myth and Reality") that found that while volumes for different categories of mail are fluctuating, mail volumes in the USA are generally flat.

Western Union Gold Card

Western Union has recently announced the introduction of the new Western Union Gold Card, which is aimed at frequent users of the Western Union money transfer service. POAAL wrote to AP asking for details of the new Gold Card, and an update on when the service will be available at post offices.

The Western Union Gold Card will enable customer details to be stored with Western Union. This should reduce the time required to complete transactions because of the details recorded on the card. AP estimates that transaction times for customers using the Western Union Gold Card should be reduced by 35%.

AP advises that its systems are currently being upgraded to accept Western Union Gold Cards from October 2005.

Western Union money transfers are a growing source of business for Licensees, and it is hoped that the Gold Card will make Western Union transactions simpler and swifter, and that there will be an increase in repeat business at LPOs.

New EPOS screens and PIN pads

AP gave POAAL representatives a preview of the new EPOS screens and PIN pads that will soon be delivered to LPOs and corporate post offices.

The new screens are a significant improvement on the existing EPOS screens. The new screens are 15" LCD flat screens. They have a larger viewable area, the screens can be tilted to different angles and there will be reduced glare, which should improve working conditions at the counter. The reduced footprint should also be well-received by Licensees.

The new PIN pads will also be a welcome step forward in technology. AP advised that the new models will be more reliable than the existing PIN pads. We hope that there will be a significant improvement in first-time scans for cards! AP is confident that the new technology, combined with recent communications upgrades, will lead to faster card processing times.

The PIN pads are very similar to the familiar models used in major supermarket chains, and this should improve the useability of the PIN pads for customers.

AP advised that the new screens and PIN pads will be delivered to LPOs over the coming months. Licensees are asked to store the equipment pending installation by AP technicians. Installations should take place in January 2006.

AP also noted that the old PIN pads will be disposed of with zero landfill, which is good news for the environment.

LPO Premises

Each individual LPO Agreement should contain a diagram of the floor plan of the LPO, showing quite clearly the agreed area which has been set aside for Australia Post products/services.

Licensees should note the word "agreed". That means that the designated area for AP must not be imposed upon the Licensee by AP - it is agreed between the parties, ie the Licensee and AP.

The agreed AP portion of the premises is to be marked clearly and unambiguously on the diagram and signed by both parties. It forms part of the LPO Agreement and must be bound in with the Agreement, not a loose-leaf addition.

In the agreed AP part of the LPO, Licensees must only stock, display, advertise and promote Australia Post sourced products and services. Bear this in mind when you are considering the layout for your LPO, as the obvious restrictions of this could have a major impact on the profitability of your business as a whole.

AP's brand and image is a valuable and recognisable one and should not be diluted by the introduction of non-AP sourced products and services in the AP designated area. As most Licensees will testify, the postal business increases when customers can easily recognise a post office - from inside or outside.

However, if you are asked by AP to designate your entire area for AP-sourced products and services, your income could be severely limited as you would not be able to obtain products from other suppliers. Be very wary if AP asks or expects you to agree to the words "stand alone" on your diagram. This means that you would not be able to stock or sell any products or services which were not sourced from AP. Is that what you want?

Senate Estimates - AP responds to questions on notice

Legal Costs

Senator Marshall had posed some questions to Australia Post representatives regarding the level of expenditure by Australia Post on external legal advice, ie funds spent on lawyers outside the AP internal corporate legal area. Australia Post responded recently, noting an extensive list of lawyers which it had used. It noted that for the 2004/05 year it spent $9,767,000 on "external" lawyers.

Bank@Post

Australia Post was asked some questions about Bank@Post by Senator Conroy. Australia Post advised that the Bank@Post rollout to manual LPOs will be completed by December 2006. The first phase, in which 20 manual LPOs were upgraded to electronic outlets, was completed by 30 June 2005.

At the end of the rollout, there will be about 540 LPOs still operating under manual conditions.

Paperwork on taking over an LPO

In response to a question on notice by Senator Conroy, Australia Post advised that a site-specific LPO Agreement is provided to the incoming Licensee approximately 30 days prior to signing.

Australia Post provided responses to several questions on notice, on matters such as Private Box installations, provision of post office services in new residential or industrial areas, Community Postal Agent disputes, and a number of Mail Contractor issues.

Variation of Award

A hearing was recently held at the AIRC to consider the pay rates in the Postal Services Industry Award. POAAL appeared at the hearing on behalf of Licensees.

The CEPU applied to the AIRC to vary the Award with respect to the Safety Net Adjustment approved by the AIRC in May 2005.

The new pay rates are available on WageNet or by ringing Wageline in your State. The new pay rates take effect from the first pay period on or after 11 August 2005 and remain in force for twelve months.

The wage increases apply to all LPOs bound to the Award. This includes LPOs that were part of the first action by the CEPU in 2002, the LPOs that were subject to the recent second log of claims by the CEPU, and all LPOs in Victoria that are subject to the Award courtesy of the CEPU's Common Rule application.

It should be noted that the Award applies to the LPO, not the Licensee, so when a logged LPO changes hands the Award still applies.

POAAL's work for Licensees in relation to the Award incurs no extra cost to individual Licensees.

Background music at your LPO

As advised by POAAL in Postal News Q2 2005 (page 9), if a radio is playing background music of the LPO, the Licensee might have to pay a license fee to APRA.

A fee also applies for playing of pre-recorded music, television, and music played as hold music.

In all these examples the Licensee requires either permission from the copyright owner or a license from the relevant authority.

The Licensee may need a licence from the PPCA in the case of playing pre-recorded music, ie CDs, tapes, etc. This is because there are at least two copyrights in any recording.

The first copyright is the copyright in the song. This copyright is covered by the APRA licence. The second copyright is in the recorded version of the musical work. The PPCA grants licences for the broadcast and public performance of recordings.

Both APRA and PPCA licence fees may be a tax deductible expense and the GST component an input tax credit. Consult your accountant to see whether or not you can claim the fees as a tax deduction.

APRA has advised POAAL that it has written to all Licensees regarding the need for an APRA licence. Please read their letter carefully and take the matter seriously.

NSW meetings

A POAAL meeting for Licensees was held at the Ramsgate RSL on Sunday 10 July. The meeting was well-attended, and featured guest speakers from the CEPU and insurance brokers GWS Genco Group.

Many lively discussions were held, covering matters such as security, margins, balancing, and LiPOMS.

POAAL would welcome input from Licensees in the Sydney area as to venues for future meetings. Your input is also welcomed on what would be the most convenient time for POAAL to hold meetings for Licensees.

A report on the meeting will appear in the next edition of POAAL's quarterly journal, Postal News.

Pricing errors in EPOS - update

At POAAL's request, AP has been investigating the problem of discrepancies between EPOS terminals in the same office in the pricing of AP-sourced products. POAAL raised this matter with AP at a national level following input from a number of Licensees across Australia.

POAAL was concerned that these discrepancies in pricing could mean that Licensees' margins are reduced by virtue of the items scanning as an incorrect (lower) price. It could also lead to conflict with customers over comparative prices.

AP has advised POAAL that where Licensees encounter this problem, they should contact the National EPOS Helpdesk to report it. AP advised that the Helpdesk has a remote process that it can run to synchronise the LPO server and terminals.

AP advised POAAL that it is developing software changes that they hope will eliminate the occurrence of pricing errors between EPOS terminals at the same outlet.

Demand Chain Management

As reported in The Australian (31 May 2005), AP is trialling a demand chain management system called Teradata. Demand chain management (or DCM) was discussed at the recent National Retail Marketing Committee meeting, in which POAAL participated.

The system being trialled collates historical retail sales data and uses that data for sales forecasting. DCM will determine purchase quantities and monitor ongoing sales performance. At present the system is being trialled in a number of corporate post offices.

AP's use of DCM was the reason for the discounting of AP retail products in the lead-up to Christmas 2004, which caused much anger and disappointment among Licensees who stock AP retail products. POAAL has reminded AP that Licensees purchase stock from AP, and that when AP discounts retail stock those discounts have an impact on Licensees.

AP has plans to further extend the use of DCM systems. An article will be published in the next edition of Postal News to give Licensees more information on how DCM will impact on Licensed Post Offices.

Other companies that use Teradata products include National Australia Bank and Vodafone.

Optus billpay - 55c charge

POAAL is disappointment that Optus has chosen to impose a 55c fee on customers who pay their Optus bill at a post office. The advice initially issued by Optus to its customers inferred that the new fee was introduced by AP. This is not the case. Future advice to customers by Optus will be re-worded.

AIRC hearing 31 May - report

POAAL represented Licensees at the recent Australian Industrial Relations Commission (AIRC) hearing in Melbourne held on 31 May 2005. The CEPU's application to "rope in" a further 318 LPOs to the Postal Services Industry Award was considered by Commissioner Foggo.

Prior to the hearing, POAAL spent considerable time negotiating with the CEPU to delete from the original list of 450 LPOs those offices which either have no staff or where postal business is not the predominant business.

At the hearing, the CEPU requested an immediate operative date for the Award at those 318 LPOs, however the Commissioner agreed to POAAL's request for a delay in commencement to the first pay period on or after 1st July 2005. This gives Licensees and their staff some time to consider the Award, including its pay rates and conditions.

This minimum rates award now applies to several hundred LPOs across Australia, including all LPOs in Victoria where postal business is the predominant business. It should be noted that the Award applies to the LPO, not the Licensee, so when a logged LPO changes hands, the Award still applies.

POAAL's work for Licensees re the Award incurs no extra cost to

National Wage Case

The AIRC handed down its National Wage Case Decision on 7 June, granting a $17 per week increase in all federal award rates. It is anticipated that the CEPU will apply to the AIRC to vary the Postal Services Industry Award in line with this increase later this year. POAAL will keep Licensees informed on this matter.

Coffs Harbour Meeting - POSTPONED

The POAAL meeting scheduled to be held in Coffs Harbour on 19 June has been postponed.

Licensees and Mail Contractors will be alerted to the rescheduled date for the meeting.

Licensee Commissions 2005/06

POAAL has completed consultations with AP regarding LPO commissions for 2005/06 as per clause 9(b) of the LPO Agreement. POAAL is pleased to announce that there will be an increase in LPO National and State Billpay Commissions and Banking Commissions for 2005/06.

Licensees should soon receive official advice from AP noting the change in commissions and the process by which these commissions are determined. Carefully inspect the advice. Licensees should also receive two copies of Annexure A, initialled by an AP representative. One copy is for you to initial and attach to your LPO Agreement. Initial the other and return to AP for their records.

AP also acceded to POAAL's request for an extension of the Interest Free Loan for security upgrades at LPOs for a further year. The hourly rate for MSP will also increase.

Bank@Post

POAAL can confirm that all LPOs that will receive AP technology under Bank@Post will have the ability to perform not only banking services but also billpay.

This is excellent news for the Licensees at these LPOs. It will provide a broad base for Licensees to continue to grow their business and improve services to their community.

The first phase of the rollout commences this month, with twenty LPOs receiving EPOS technology. The remainder will be installed in the following 18 months to the end of 2006.

EPOS terminals

Licensees are reminded to leave EPOS terminals switched on at all times. EPOS terminals should only be switched off when specifically instructed to do so by EPOS Help Desk staff.

Software downloads are often performed out of hours, money order hotlists are also downloaded out of hours, SABS, and many other back office information and functionality. If the terminal is turned off, these downloads cannot take place.

AIRC hearing - 31 May 2005

Superannuation choice

From July, new Federal Government legislation will come into effect which gives many employees the right to choose which superannuation fund will receive their employer superannuation guarantee contributions. This is known as choice of superannuation fund.

If you make superannuation contributions for any of your employees (even if they are casual or part-time) you should become familiar with your obligations as an employer under choice of superannuation fund.

Postpoints and LSVs

Following an enquiry from a Licensee, POAAL approached AP for clarification on the sale of Express Post items by Licensed Stamp Vendors and Postpoints. The Licensee was concerned that another business in his town was selling Express Post items.

AP has advised that LSVs are only licensed to sell postage stamps. Postpoints, on the other hand, are allowed to sell Express Post products in some circumstances. Licensees can apply to AP to sell stock to Postpoints. Contact your POAAL State Chairman for more information.

2005/06 Membership & Insurance

Membership and insurance renewal forms have been sent to Licensee members of POAAL.

This year POAAL offers Licensees two choices of public liability insurance coverage - $10m or $20m. The LPO Agreement requires Licensees to have $10m public liability for the LPO, however some leases (for example, LPOs situated in shopping centres) require $20m public liability insurance.

Insurance certificates will be provided for public liability insurance. Please ensure that you give AP a copy of your certificate and that you retain the original.

A tax compliant invoice/receipt will also be issued.

Online banking continues to grow

Analysis by the Market Intelligence Strategy Centre (MISC) has shown growth of 7.3% for online banking for the December 2004 quarter.

Research suggests that many new users of online banking have been attracted by new online high interest savings accounts. MISC reports that there are not more than 7 million registered users of internet banking in Australia. Data was collected from a pool of banks, including the Commonwealth, that account for about 89% of all internet bank transactions.

MISC also reported that another factor drawing customers to internet banking was growing confidence, increased security measures and ongoing consumer education.

Bank@Post

The Federal Government has announced details of the Bank@Post programme. POAAL has been lobbying federal politicians and AP to extend electronic banking services to manual LPOs - especially those in rural areas - for some time. It is satisfying to see that the Bank@Post programme targets these LPOs, and the programme should offer Licensees the opportunity to grow their business and increase the services they can offer to their local community.

The programme has been given $9.7m over four years to make Bank@Post available at over 200 manual LPOs that each perform more than 2,500 transactions pa.

AP has agreed to accept responsibility for a further 7 years for any technology shortfall fees incurred at LPOs where the number of annual transactions fails to reach the 10,000 transaction threshold.

POAAL has lobbied strongly on behalf of Licensees at manual LPOs for banking services to be extended to their businesses. POAAL successfully lobbied for many manual LPOs to received EPOS under the Rural Transaction Centre programme. We continued to lobby federal politicians after the RTC Programme funding had ceased, and Bank@Post follows on from the RTC Programme.

Twenty LPOs have been earmarked to receive Bank@Post by June 2005. The remainder will receive the service in the following 18 months.

Mail2Day - update

Australia Post has responded to POAAL's extensive comments to them regarding the potential impact of Mail2Day on LPO operations. Licensee members will recall that POAAL collated responses from Committee members and Licensees from all over Australia.

    Some of the significant points from AP's response:
  • the Licensee commission will be reviewed for the coming financial year
  • AP is confident that the netPOS system will be able to cope with the volume of users who would access the Mail2Day application during an intense period prior to 9am opening
  • Mail2Day activity will not count towards an EPOS terminal's transaction count
  • Mail2Day notifications will be sent to customers once per day
  • additional mail received during the day is not to be advised to customers
  • the costs of a scanner would be borne by AP if the LPO qualifies for a PDET scanner
  • there are no outgoing phone calls associated with Mail2Day

International Cheques

Many Licensees have noticed the impact of buying and selling via EBay is having on the postal business. Vendors are posting goods to buyers, and buyers are often paying via money order. Licensees should be alert to international cheques being presented for deposit by vendors, especially when drawn on an ANZ account or other banks with an Australian and international presence.

Check that all cheques presented for deposit are drawn in Australian dollars against an Australian bank. One Licensee reported that a customer presented an ANZ cheque drawn against a New Zealand branch. The cheque was remarkably similar to a cheque drawn against an Australian ANZ branch.

EPOS network upgrade

Licensees at EPOS LPOs may already be aware that Telstra representatives will be carrying out work at LPOs on the EPOS communications network.

POAAL has sought clarification from AP as to what work will be involved, what potential business disruption there might be, and what security exposure there might be. POAAL emphasised that the timing of the work must be sensitive to the business needs at the LPO, for example, any network outages at 10am on a Thursday would have a much greater impact than a network outage out of hours.

The purpose of the work is to improve speed and reliability of the EPOS communications network.

AP has advised that the work will be carried out over the next six months by Telstra staff or Telstra contractors. The Licensee will be alerted in advance of the proposed timing of the visit. The Telstra representative will need to be on site for less than an hour. It is hoped that there will only be a minimal "outage", and that any interruptions to the EPOS network will be for less than five minutes. The Telstra representative will perform work inside and outside the LPO.

Licensees should ensure that Telstra staff or contractors do not inadvertently (or otherwise) contribute to a security breach. For example, ensure that the Telstra representative doesn't accidentally leave the back door of the LPO open.

The ACCC yesterday released the Record Keeping Rules specifying information to be provided by AP under recent amendments to the Australian Postal Corporations Act 1989.

POAAL submissions to Senate Inquiries

POAAL recently made submissions to two Senate Inquiries regarding the Workplace Relations Amendment Bill. The first submission related to unions' right of entry to the workplace. The Committee has released its report, and it is available as a PDF from the Parliament House website.

POAAL pointed out some of the issues surrounding redundancy payments to staff at LPOs, including capacity to pay and transmission of business. New Insurance Broker

POAAL National Office

The telephone system at the POAAL National Office is being upgraded, commencing Friday afternoon 11 March. Postal Industry Ombudsman Bill

POAAL has been advised that the Postal Industry Ombudsman Bill passed the Senate with one amendment on Monday 7 March.

The ALP proposed that the Bill be amended to include private postal operators with more than 20 employees and greater than $1m annual turnover. This amendment would mean that operators such as FedEx and DHL would be covered by the PIO.

Some might say that there are very few complaints regarding private postal operators, but that could simply be a result of there being no appropriate body existing to hear complaints.

The legislation must now go before the House of Representatives.

Commissioner Grainger today handed down his decision relating to the CEPU's ambit log of claims sent to a number of Licensed Post Offices in 2004.

The Commissioner has found a dispute exists between the CEPU and a number of Licensees who were subject to the CEPU's log of claims. He has directed the parties to confer on the issues in dispute.

POAAL will again be looking after Licensees' interests in this matter. Discussions with the CEPU will commence in due course.

POAAL offered to represent all Licensees affected by the CEPU's action at no extra cost to individual Licensees. POAAL appeared in the Australian Industrial Relations Commission (AIRC) on behalf of the majority of those Licensees at hearings held in late 2004 and early 2005.

It is expected that the Licensees against whom a dispute was found will be "roped in" to the Postal Services Industry Award.

POAAL will keep Licensees up-to-date with significant developments in this matter.

National Retail Marketing meeting highlights

Express Courier International

POAAL and CEPU representatives welcomed this new initiative of Australia Post's International Group. POAAL believes that this is a product and service which will be attractive to customers because of its ease of use and speed, and Licensees will promote it for the same reasons.

Express Courier International is scheduled for introduction in late March and Licensees have been advised some details by AP. AP advises that this product will replace EMS International Courier.

Mail2Day *

POAAL has been inundated with questions and concerns from Licensees in all States and Territories since AP started promoting its Mail2Day service which is due to start officially soon after a limited trial in a few corporate outlets.

As soon as AP advised POAAL of this proposed new service for private box holders, we circulated all State committee members asking for comment. These comments were collated by two senior POAAL Directors into a detailed response to AP. The matter was discussed at the recent National Retail Marketing Council meeting and again the POAAL representatives made strong comment. The matter will no doubt also be discussed at the next National Consultative meeting and this will be expanded to include LPO payments for Mail2Day as well as the practical considerations inherent in a service like this.

Philatelic

AP previewed some of the forthcoming philatelic issues for 2005. AP has planned some exciting and colourful issues and it is anticipated that they will sell well. Some issues are planned to have merchandise tie-ins. This is a great add-on for sales in LPOs. POAAL representatives gave AP feedback on customer response and sales results of previous issues, including the Legends series. Licensees appreciate the margins they are able to achieve on Philatelic and appreciate AP’s help in promoting stamp issues and associated merchandising items.

Discounting

POAAL representatives raised the issue of AP discounting of their retail products, especially the pre-Christmas discounting that occurred in December 2004. Senior AP management will make a presentation on AP's discounting strategy at the next Marketing Council meeting.

Postal Industry Ombudsman Update

The Postal Industry Ombudsman Bill is expected to be introduced in the Senate on Monday 7 March.

Prior to last October's federal election, both the Liberal Party and the Labor Party committed to setting up a Postal Industry Ombudsman (PIO).

The first discussion paper regarding a PIO in Australia was published in 2002, and POAAL has supported the concept from the beginning. POAAL made a detailed submission in response to the discussion paper. It was pleasing to see that many of our suggestions were incorporated into the PIO model.

This week POAAL has been in contact with the Minister's office and also the Shadow Minister's office, reminding them of POAAL's support for the PIO.

The PIO will provide a mechanism for customers to resolve disputes with Australia Post, and possibly customer complaints against other postal operators. It will also provide another avenue for Licensees, Mail Contractors and Community Mail/Postal Agents to air issues relating to postal matters.

On the whole, if correctly implemented, the PIO should lead to an even more reliable and professional postal service in Australia.

Award updates via Wagenet

POAAL wrote to the Minister for Workplace Relations pointing out that the Wagenet website was not user friendly for Licensees seeking the most up-to-date information on the Postal Services Industry Award.

The Minister asked the Department to contact POAAL and we pointed out ways in which Licensees could more easily access information on wages.

One of the things that Licensees can do in this regard is to sign up for free updates on the federal Postal Services Industry Award at the Wagenet website.

Visit the subscription page of Wagenet and enter your email address and the code for the Postal Services Industry Award - AW830245. You will then be notified of any changes to the Award, such as safety net wage adjustments. If you change your email address you will need to re-subscribe.

It's a free service, so don't delay in signing up so that you can be kept up-to-date of any changes to the federal Postal Services Industry Award.

This is just another way in which POAAL helps its members.

Cheques - going the way of the dodo?

A recent report shows that in 2004 internet banking transactions numbered more than personal cheque transactions in Australia. Is this the way of the future? If it is, over-the-counter post office transactions involving cheques may gradually decrease in volume, and Licensees may have to look for other products and services to fill the gap which will appear as internet and over-the-phone banking and billpay gain in popularity.

Bank@Post

The Federal Government has announced further details of the Bank@Post programme.

Bank@Post was first announced as part of the Coalition's postal policy document. Bank@Post was designed to be a programme to extend banking services to rural and remote communities. This followed community need and much lobbying by POAAL to obtain wider services for manual Licensed Post Offices.

266 LPOs have been earmarked for the new service, the majority of which are in rural and remote areas.

It is hoped that this service will increase business, increase foot traffic and improve the bottom line of these selected Licensed Post Offices.

The programme will be administered by the Department of Transport and Regional Services (DoTARS). DoTARS also administered the rollout of the Rural Transaction Centre Programme, a large number of which were installed in manual rural LPOs.

Senate Estimates

The Shadow Minister for Communications, Senator Stephen Conroy, pressured AP managers to respond to many questions and points of interest to POAAL members during recent Senate Estimates hearings.

In particular, AP was questioned on the subject of LPO premises, and other products and services in LPOs.

A meeting for WA Licensees is being held in Perth on Sunday 30 January at the Ascot Inn.

AIRC Hearing - 7 January

Postal Services Industry Award update

The second hearing regarding the most recent log of claims from the CEPU was held at the Australian Industrial Relations Commission (AIRC) in Melbourne on 7 January. POAAL attended the hearing in Melbourne, representing the vast majority of Licensees affected by this action.

The purpose of the hearing was to finalise the list of Licensees against whom the CEPU sought a dispute finding. Following the previous AIRC hearing in November 2004 the CEPU was instructed to send further information to the small number of Licensees against whom they sought a dispute finding but who had not authorised POAAL to act for them or had not responded directly to the CEPU or AIRC.

The Commission directed the CEPU to finalise the list of Licensees against whom they are seeking a dispute finding.

The next step in this process will most likely be that the CEPU will seek to "rope in" those Licensees who have had a dispute found against their business. This means that those Licensees will be made respondent to the Postal Services Industry Award, and will be bound to pay their staff under the terms and conditions of the Award. Of course, Licensees always have the option of setting up AWAs for their employees.

It should be noted that it is the Licensed Post Office that will be "bound" to the Award. If an LPO bound to the Award changes hands, staff at the LPO are still to be employed under the conditions of the Award.

Common Rule Application by the CEPU

POAAL appeared in the Australian Industrial Relations Commission on 16 December on behalf of all Victorian Licensees. The CEPU has applied to the AIRC to make the Postal Services Industry Award common rule for all eligible LPOs in Victoria. In short, this means that all Victorian LPOs where postal business is the dominant business will be obliged to pay under the Award. The exceptions will be LPOs where AWAs are in place, or where the postal business is not the dominant business. The CEPU wanted coverage to commence from 1 January 2005, however the Commissioner agreed with POAAL's argument and the common rule coverage will commence from 1 February 2005.

AIRC hearing - second log of claims

The AIRC hearing regarding the CEPU's second log of claims against Licensed Post Offices was held on 16 November. Commissioner Grainger found that there was a dispute between the CEPU and a number of LPOs. Licensees affected by the claim who had not responded to the log, either by authorising POAAL or by responding directly to the CEPU, have until 21 December to respond to the claims. A further hearing is scheduled for7 January 2005 to decide whether or not a dispute will be found against those remaining LPOs.

Licensees who have received the current log of claims who have not responded either directly to the CEPU or by authorising POAAL are urged to take immediate action.

Post-election Update

The 2004 federal election is over, the Coalition has been returned to Government and all that remains now is for a few tight contests and Senate seats to be decided. Many thanks to all those Licensees and Mail Contractors who lobbied candidates during the election campaign, reminding them of the valuable work done by people who are contracted to Australia Post.

POAAL also lobbied strongly during the campaign and it was good to see that the major parties acknowledged the work put in by Licensees and Mail Contractors.

We note that the Coalition, which has been returned to parliament, pledged to keep Australia Post in public ownership. The Coalition says it remains committed to the current regulatory arrangements and has no intention of introducing any further postal deregulation.

POAAL also notes the Coalition’s commitment to securing passage of the Postal Industry Ombudsman Bill 2004. POAAL fully supports the introduction of the PIO.

We will be following the Coalition’s small business paper Promoting an Enterprise Culture with a great deal of interest.

The Coalition has advised us that they "...look forward to continuing [their] positive and constructive working relationship with POAAL in the future."

We appreciate the work done by various MPs supporting the role of Licensees and Mail Contractors over the past parliamentary term. POAAL will be doing its best to ensure that all re-elected and new members of parliament are made aware of the role of the people that the current Minister for Communications, Senator Helen Coonan, called "the backbone of the postal industry" and "a key part of the postal sector and [who] have an important role to play not only in delivering postal services but also within the communities in which they operate."

We will introduce ourselves to the relevant portfolio holders now that the Cabinet has been announced by the Prime Minister. POAAL will continue to lobby and work for Licensees, Mail Contractors and Postal Agents.

POAAL representatives met with Joe Hockey MP, Minister for Small Business and Tourism, late in September. The meeting was positive and constructive. Mr Hockey pointed out that the Coalition was keen to look after the interests of small business, and referred to their policy document Promoting an Enterprise Culture.

Protected Products and Premises

Post office Licensees should be aware of the provisions of their agreement with AP which lists six products and services which are "protected" by AP.

It is not necessary for Licensees to advise AP when stocking non-AP sourced products and services, provided that they comply with both the Annexure B restrictions and the restrictions of the floor plan attached to each individual LPO Agreement (Item 2b of the Schedule). Licensees should check the floor plan attached to their LPO Agreement to ensure that it clearly designates the AP portion of the post office business. Both the Licensee and AP must agree on this area - it must not be imposed on the Licensee by AP. The floor plan defines the area which the Licensee has allocated for post office work, and must include a counter area, the scales, EPOS and safe. It usually includes an area of designated public space in front of the counter. It need not include the whole counter area. Licensees should take care to ensure that the defined "post office" part of the floorplan is kept free of non-AP products, eg confectionery, magazines, gifts and so on.

This designated area should be reviewed from time to time, in light of changes to products, services, equipment, office layout, and so on.

Licensees should refresh their understanding of their Agreement by reading it from time to time. Licensees should be fully aware of the provisions of their own LPO Agreement and feel confident that they know their own rights and responsibilities and those of their principal.

If an LPO is operated with no obvious in-conjunction business such as a newsagency or general store and only AP-sourced products and services are sold, the Licensee could be eligible to receive rental subsidy from Australia Post. Check the LPO Manual, section 1.2.5

The use of Australia Post's name and logo are covered under clauses 12n) and 16 of the LPO Agreement. The words "Australia Post" or their logo must not be used in any type of advertising without first obtaining written permission from AP.
